General Terms and Conditions

1. Provider and scope

The provider is Marcel Huy, trading as Huy Digital, Mittelstrasse 5, 3414 Oberburg, Switzerland. These Terms apply to huymarkets.com, the web app, desktop terminal, local or cloud connectors, notifications, market-data, analytics and AI functions, and related services.

Different terms apply only if expressly confirmed by us in text form. Mandatory consumer rights remain unaffected.

2. Eligibility and account

Users must be at least 18 years old and legally capable of entering into a contract. Registration details must be accurate and current. Login details must not be shared and suspected misuse must be reported immediately.

Accounts are personal. Users may connect several trading accounts they own where broker, exchange and data-provider terms allow it. Circumventing plan, licence, security or user limits is prohibited.

3. Service

HuyMarkets provides software for displaying and analysing market, account and trading data and for technically transmitting the user's own instructions. Features depend on the selected plan, connected provider, available interface and any separate data entitlement.

The feature description, pricing page and checkout define the purchased service. Beta, test and preview functions may be limited, error-prone or temporarily unavailable and are labelled accordingly.

4. No investment advice or custody

HuyMarkets is a software and information platform. We do not accept or hold client funds or assets and are not a party to the user's contract with a broker, exchange or data provider.

Market data, signals, explanations, model calculations, AI output and other content are general information and technical aids. They are not personal investment, legal or tax advice and do not guarantee any result. Users make and remain responsible for their own decisions.

5. Broker, exchange and data connections

External accounts are also subject to the relevant broker, exchange or data-provider agreement and fees. Users must hold all required accounts, subscriptions, permissions and usage rights.

Credentials for locally connected MT4/MT5 systems normally remain on the user's device. Credentials for supported cloud exchanges may be stored encrypted on our servers where required for the requested feature. Users should grant only the minimum API permissions and disable withdrawal permissions unless strictly required.

6. Order transmission, quick trading and automation

An order triggered through HuyMarkets is a technical transmission to the provider selected by the user. Execution, price, partial fills, rejection, slippage, margin and liquidation are governed by that provider and market conditions.

Quick-trading and automated functions are not enabled as an unrestricted mandate by default. They operate only after explicit activation and within user-defined limits. Protective settings such as stop loss or daily limits cannot reliably prevent losses, particularly during gaps, outages or exceptional volatility.

7. AI features

AI output may be incomplete, misleading or wrong. It does not replace independent review or professional advice. Before any risk-bearing action, users must verify that the symbol, direction, account type, size, price, stop loss and take profit match their intent.

Where autonomous functions are offered, the additional approvals, limits and safeguards shown in the product apply. We may refuse execution where data are missing or contradictory, a technical failure occurs or a safety limit is exceeded.

8. Market data and content

Market data may be delayed, aggregated, estimated, corrected or temporarily incomplete. Users must observe the displayed timestamp and source information. Data may be used only within the displayed feature and applicable licence terms.

Automated extraction, resale, mirroring or public redistribution of the platform or its data requires our prior written consent.

9. Prices, trial and payment

The prices and features shown before checkout apply. Prices include applicable taxes where required. External broker, exchange, data, network and conversion fees are not included unless expressly stated.

A free trial ends at the displayed time. Paid subscriptions renew for the period shown at checkout until cancelled. Stripe processes payments. Purchased AI credits are not money, are non-transferable and may be used only for the designated HuyMarkets features.

10. Cancellation, withdrawal and refunds

Subscriptions may be cancelled in the customer area or Stripe billing portal with effect at the end of the current billing period. Mandatory withdrawal, warranty and refund rights remain unaffected.

Where legally permitted, started or fully supplied digital services, consumed AI credits and partially used billing periods are not refunded pro rata. If a material failure is attributable to us, we will assess an appropriate credit or refund.

11. User obligations

• do not use the service unlawfully, abusively or in a way that compromises security;
• do not share third-party credentials or connect accounts without authority;
• do not bypass limits, suspensions, data licences or access controls;
• do not overload the service, distribute malware or run mass queries outside approved interfaces;
• comply with personal tax, reporting, sanctions and regulatory duties.

12. Availability and changes

We operate HuyMarkets with reasonable care but do not promise uninterrupted or error-free availability. Maintenance, safeguards, third-party failures, network or power outages and force majeure may affect the service.

We may change features for security, legal, third-party or technical reasons provided the contractual core benefit is not unreasonably reduced. Material adverse changes will be communicated in advance.

13. Intellectual property

HuyMarkets software, design, data models, analyses, text and marks are protected. For the contract term, users receive a personal, non-exclusive and non-transferable right to use the service as intended.

Users retain rights to their own content and trading ideas. Content submitted voluntarily for analysis or publication is governed by the usage terms expressly accepted in the relevant dialog; it is not publicly published without such confirmation.

14. Liability

We remain fully liable for intent, gross negligence and wherever limitation is prohibited by law. For slight negligence, liability is limited to a breach of material contractual obligations and the typically foreseeable loss.

Where permitted by law, we are not liable for trading losses, lost profits, data or price errors, decisions based on AI output, or failures at brokers, exchanges, data, payment or communication providers. This does not shift any mandatory legal responsibility to the user.

15. Suspension and termination

We may temporarily suspend access where there are concrete signs of abuse, a security incident, overdue payment or a serious breach of these Terms. Where reasonable, we will inform the user first and allow clarification.

After termination, personal data are erased or restricted in accordance with the Privacy Policy, subject to statutory retention and necessary evidence.

16. Final provisions

Swiss law applies, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules and mandatory statutory venues remain unaffected. Otherwise, the courts at the provider's registered place of business have jurisdiction.
